If there is a Will, the probate is referred to as a testate estate —or if there is no Will, it is referred to as an intestate estate. In Colorado there are three types of probates: Small Estates: under $70,000 (2021) and no real property. Informal Probate: uncontested estates with a valid Will. Formal Probate: for contested estates and invalid or questionable Wills. Probate law is a unique and complex field.
